Azerbaijan’s Milli Majlis has approved, in its third reading, new rules governing procurement by state enterprises, state-owned business entities and public legal entities. The amendment changes the Law on State Procurement.
The bill was discussed at a Milli Majlis session on October 23 and passed in its third reading. The amendment sets a new framework for the procurement process at enterprises run by state bodies, business entities with state shareholdings, and public legal entities, as well as legal entities they founded or participate in.
Under the new rules, the Law on State Procurement will no longer apply to goods, works and services purchased by these entities using funds from sources other than the state budget, the budget of the Nakhchivan Autonomous Republic, budget loans, subsidies, state-guaranteed credits, state grants and aid, or off-budget state funds.
Instead, the procedure for purchasing such goods, works and services will be approved by a body designated by the relevant executive authority. Procurement in this category will therefore be carried out under a separate regulatory regime.
