Milli Majlis panel weighs fines up to 1,050 manats for public service breaches

The Milli Majlis Committee on Legal Policy and State Building has discussed a draft article to be added to the Code of Administrative Offences. The measure would impose fines of 250 to 1,050 manats on officials for violations in the delivery of public services.

The proposed norm would become Article 594-3 of the Code of Administrative Offences and covers a range of violations in the provision of public services. Under the draft, failing to notify users electronically about upgrades to the information systems used to deliver services would carry a fine of 250-350 manats. Failing to inform users of the rules for receiving a service would cost officials 350-450 manats.

The draft also sets out a separate clause on payments for electronic services. Officials responsible for a service would face a fine of 450-550 manats if they fail to create the option to pay a state fee or service charge electronically. Failing to issue an applicant with an administrative act, technical document or other legal document required by law, or failing to provide necessary information, would result in a fine of 550-650 manats.

Not informing applicants of the legal grounds for refusing or suspending a service, or of their right to appeal, would be punished with a fine of 650-750 manats. Failing to create conditions for people with disabilities to access public services, or failing to provide them with mobile service where required by law, would carry a fine of 750-850 manats.

Providing a service without entering the relevant data into the Electronic Registry of Public Services would require a fine of 850-950 manats. The highest fine – 950-1,050 manats – would apply to cases where a service is not provided despite the requirements of legal acts, or where users are not informed about the outcome of their request.
